A claim is a request that your health insurance company pay for a product or service that you think is covered. It's the same with the account. The first step in the appeal process is an internal appeal (Figure 2). An internal appeal is usually initiated by writing to your insurance company. Either fill out the required forms from your health insurance company or send them a letter explaining your situation along with your name, claim number and health insurance ID. Include supporting documents, such as a letter from your doctor, that may help you with your application. You must submit this request within 180 days (6 months) of receiving notice that your request was denied. After filing, the insurance company is obliged to reconsider its decision.

If your grievance is still denied after an internal review, you can proceed with your appeal by submitting an external review.

The Federal Claims Regulations of 2010 established broad consumer appeal rights in the event of any dispute about how a claim was covered. The ruling required that all negative benefit decisions—whether a denial or partial payment of a claim, or an in-network or out-of-network cost-sharing application—should be subject to an internal appeal, meaning the consumer has the right to ask the health plan to review any such decision. The 2010 regulation also required that all negative definitions of verified benefits in the plan be eligible for independent external review. Transparency data provided by the federal and state governments shows that health plans tend to support the most unfavorable definitions of benefits that are contested internally. By contrast, denials that were challenged from the outside were generally rejected. For example, the 2020 Maryland Rejection and Appeals Report shows a 64 percent reversal rate for denials that were subject to external appeal.

The 2015 amendments also required that, upon receipt of a request for an external appeal, the group health plan complete a pre-screening to determine if the request was admissible. If the plan determines that the claim is ineligible, it must notify the consumer of the reason and provide a toll-free number to call the US Department of Labor. The ruling does not describe any other remedy for consumers who do not agree with the health plan's definition.

External calls are usually conducted by Independent Auditing Organizations (IROs).
